1. Agreement
1.1 By participating in one-on-one music lessons with WillYouLearn, whether in-person or online, you agree to adhere to the terms and conditions outlined herein.
2. Lesson Structure and Content
2.1 WillYouLearn is dedicated to delivering music lessons with a distinctive pedagogical approach involving listening, imitation, reading, and study.
2.2 Lesson content includes sight reading, songwriting, music theory, ear training, improvisation, and various musical genres, as determined solely by the teacher.
3. Online and In-Person Lessons
3.1 Virtual students may choose fully remote lessons or a hybrid model, including two in-person lessons per semester.
3.2 In-person lessons in NYC follow NYC public school guidelines for health and safety, with adjustments made for NYC school closings.
4. Scheduling
4.1 Fully enrolled students operate on a semester basis, consisting of 18 consecutive weeks, including 16 weeks of lessons and a two-week make-up period.
4.2 Students can enroll at any time during the semester, choosing in-person or online lessons. If an in-person student switches to an online lesson, no cost difference will be refunded.
5. Enrollment
5.1 New students undergo a complimentary consultation for optimal teacher matching.
5.2 Existing students auto-renew, with an exclusive period in June and November for schedule adjustments.
5.3 A tuition deposit may be submitted before the Fall semester to secure a spot. While it doesn't guarantee a preferred teacher, it gives preference to day and time requests. Refunds can be requested up to 30 days before the semester starts.
6. Billing
6.1 Balances are due by the specified date on the invoice.
6.2 Accounts exceeding a 30-day overdue period incur a 6% late fee.
6.3 Notice actions for overdue accounts: 1. Courtesy Reminder, 2. Overdue Notice, 3. Final Warning Notification and Late Payment Fee, 4. Suspension of Service Notice, 5. Default Notice.
6.4 Cancellation of lessons due to delinquency requires payment of the outstanding invoice in full.
7. Withdrawals and Refund Policy
7.1 New students may withdraw within the initial three weeks, receiving a prorated refund. After this period, commitment for the semester is obligatory. Established students require one month's written notice before the start of a new semester for discontinuation, with inadequate notice incurring charges equivalent to the first month of lessons.
8. Student Cancellations
8.1 Semesterly students receive up to two permissible absences per semester, qualifying for make-up lessons. Frequent cancellations beyond this limit do not warrant additional make-up credit.
8.2 Lessons canceled without a 24-hour notice are ineligible for rescheduling or make-up.
9. Make-Up Period
9.1 Each semester concludes with a two-week make-up period, offering optional mid-session make-up lessons contingent upon mutual availability.
9.2 During the designated make-up period, students with fewer make-up credits than make-up days are offered optional additional lessons at their usual time for an additional fee. Students may opt out of optional additional lessons with notice requirements.
10. Lesson Cancellation Procedures
10.1 Cancellations must be executed exclusively through the student portal for eligibility of make-up credit.
11. Teacher Absences
11.1 Teacher cancellations may be mitigated through substitute instructors or rescheduled lessons, with families promptly notified via email. Should a student refuse the substitute, the lesson will count towards a students allowable make-up credits.
12. Adult Supervision
12.1 For students under 18, the presence of an adult during lessons is mandatory. Failure to comply results forfeiture of the lesson. Teachers are not allowed to enter the home of an unsupervised student and must leave if found with an unsupervised student, with no make-up credit offered.
13. Punctuality
13.1 While WillYouLearn's faculty strives for punctuality, minor variations may occur. Lessons, however, will consistently total the full scheduled length of the lesson from the time the teacher enters the students home.
13.2 In cases where the student is absent upon the teacher's arrival, a 15-minute grace period is observed. Beyond this timeframe, no make-up credit will be granted.
13.3 Should a student arrive late for any lesson, the lesson will end at the scheduled time and no additional time will be offered to future lessons.
14. Health and Safety
14.1 In instances of a student's contagious illness, the teacher may leave, with no credit issued for the missed lesson.
14.2 A parent or guardian must be readily accessible during emergencies. Teachers are not obligated to assume duties beyond their expertise as music educators.
14.3 Unforeseen events may necessitate the shift to virtual lessons for health and safety concerns with no refunds provided.
14.4 In the event of potential COVID-19 exposure, in-person lessons during the isolation period must be promptly canceled.
15. Our Relationship
15.1 Clients expressly agree not to directly engage, solicit, or hire any WillYouLearn instructors, including themselves, for music lessons or any related services outside the scope of WillYouLearn.
16.2 The engagement, recruitment, or employment of WillYouLearn instructors by clients, directly or indirectly, is strictly prohibited during the period of their enrollment and for a duration of one year following the termination of their association with WillYouLearn.
16.3 Violation of this clause may result in legal action, including but not limited to the pursuit of damages, injunctive relief, and any associated legal costs.
16. Teacher-Parent Communication
16.1 WillYouLearn acknowledges the importance of effective communication between parents and teachers. However, to ensure a focused and conducive teaching environment, teachers should only be contacted for last-minute cancellations and emergencies.
16.2 Any discussions, inquiries, or feedback related to lessons, progress, or other matters must be conducted during the designated lesson time or may be directed to [email protected]
16.3 Excessive contact outside of last-minute cancellations and emergencies may disrupt the teaching process and is discouraged. WillYouLearn reserves the right to address any communication concerns and, if necessary, facilitate a more appropriate channel for discussions between parents and teachers.
